Terms of Service

These Terms of Service (“Terms”) are an agreement between you and [legalName], [address] (“ListingSignal”, “we”, “us”). They apply when you create an account or use the ListingSignal website and app (the “Service”). If you use the Service for a team or brokerage, you agree on its behalf and confirm you are allowed to. If you don’t agree, please don’t use the Service.

1. What ListingSignal does

ListingSignal helps licensed real estate professionals stay in touch with people they already know. You upload your contacts, we match each address to public property records, and we send those contacts a monthly home value email branded to you. We show you who opened, clicked, or asked for a value, and a rules-based “sell score” to help you decide who to call.

Home values, sales and ownership details come from third-party data providers and public records. They are automated estimates, not appraisals or broker price opinions, and they can be incomplete or wrong. Sell scores are guides, not predictions. Don’t rely on either as professional advice, and don’t present them as an appraisal.

2. Your account

  • You must be at least 18 and use the Service for your real estate business in the United States.
  • Keep your login secure. You are responsible for activity in your account, including by teammates you invite.
  • Give us accurate information, including the name, brokerage, license number and office address shown in your emails.
  • Each person may own one ListingSignal account. Team members join the owner’s account by invitation.

3. Your contacts and your responsibilities

You are the sender of every report, and you are responsible for who you send it to. You agree that:

  • You only upload people you have a real relationship with (past clients, your sphere, people who asked to hear from you) and who agreed to receive emails from you.
  • You confirm that permission on every import, and we keep a record of who confirmed it and when.
  • You will not upload purchased, rented, or scraped lists, or use the Service for cold outreach.
  • You follow the laws and rules that apply to you, including CAN-SPAM, the Telephone Consumer Protection Act and Do-Not-Call rules when you phone contacts, state real estate advertising and licensing rules, fair housing laws, and your brokerage’s policies.
  • Every email will keep your office address and a working unsubscribe link. You won’t re-add or email anyone who unsubscribed.

For the contact data you upload, you are responsible for having the right to share it with us, and we act on your instructions to provide the Service.

4. Plans, free trial, and billing

The Service is offered on these subscription plans:

  • Homes. A home is a contact we have matched as the owner of their address. Contacts we can’t match, or who don’t own the address, don’t count. If you reach your limit, extra addresses wait in a queue and are looked up when you have room. We may also pace lookups per day to keep the Service reliable.
  • Free trial. New accounts can start a 7-day free trial. A payment card is required. The trial includes up to 10 address lookups. One trial per person and per payment account; if you have already had a trial, billing starts right away.
  • When you are charged. Unless you cancel before your trial ends, your plan starts and your card is charged automatically on the day the trial ends. After that, your subscription renews automatically each month or year, at the current price for your plan, until you cancel.
  • Changing plans. You can switch plans from Settings → Billing. Upgrades and downgrades during a paid period are prorated by Paddle. Switching during the trial isn’t charged until the trial ends.
  • Price changes. If we change prices, we will email you at least 30 days before the change applies to your subscription, and you can cancel before then.
  • Taxes. Prices are in US dollars and exclude sales tax, which Paddle adds where required.
  • Failed payments. If a payment fails, Paddle will retry it. Reports may pause until payment succeeds, and we may cancel the subscription if it stays unpaid.

5. Paddle is our reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a subscription you are buying from Paddle, and Paddle’s Buyer Terms also apply to that purchase. For help with a charge, you can also contact Paddle at paddle.net.

6. Canceling and refunds

You can cancel at any time from Settings → Billing. If you cancel during the free trial, it ends right away and you are not charged. If you cancel a paid plan, you keep access until the end of the period you paid for and are not charged again. We offer a 14-day money-back guarantee on your first payment and on yearly renewals; see our Refund Policy.

7. Your data

You own the contacts and content you upload. You give us permission to store, process and use them only to provide, secure and improve the Service, as described in our Privacy Policy. You can export your contacts as a CSV at any time from Settings → Data & account, and you can delete your account and its data there. After cancellation, your data stays in your account so you can come back, until you delete it.

8. Acceptable use

You agree not to:

  • send spam, misleading or unlawful content, or anything that discriminates in violation of fair housing laws;
  • impersonate another agent or brokerage, or misstate your license or office address;
  • resell, scrape, or bulk-export property data from the Service, or use it to build a competing data product;
  • access other customers’ data, probe or bypass security or plan limits, or disrupt the Service;
  • create multiple accounts to get extra free trials.

We may suspend or close accounts that break these rules, cause high bounce or complaint rates, or put our email reputation or other customers at risk. Where reasonable, we will tell you first and give you a chance to fix it.

9. Third-party services

The Service relies on providers such as our property data source, email delivery service, and Paddle. Their data and availability are outside our full control, and their terms may apply to parts of the Service.

10. Availability and changes

We work to keep the Service available and your data safe, but we don’t guarantee it will be uninterrupted or error-free. We may improve or change features. If we make a change that materially reduces what you paid for, you may cancel and ask for a prorated refund of the unused period.

11. Disclaimers

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, accuracy of property data, and non-infringement, to the extent the law allows.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or commissions. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim.

13. Indemnity

You will defend and indemnify us against third-party claims arising from the contacts you upload, the emails sent on your behalf, your calls and other outreach, or your breach of these Terms or applicable law.

14. Ending these Terms

You can stop using the Service and delete your account at any time. We may end these Terms on 30 days’ notice, or immediately for a serious breach. If we end them without cause, we will refund any prepaid fees for the unused period.

15. Changes to these Terms

We may update these Terms. For material changes we will email account owners at least 14 days before they take effect. Continuing to use the Service after that means you accept the new Terms.

16. Governing law and contact
